Terms and Conditions of Sale

These Terms and Conditions of Sale (T&Cs) apply to all bookings made with THEAVA SAS via the website theava-collection.com, by email, telephone, or any other booking channel.

Any booking implies full and unconditional acceptance of these Terms and Conditions.

2. Purpose

These T&Cs define the terms and conditions for booking, payment, cancellation, and stay of the apartments offered by THEAVA SAS as part of furnished seasonal rentals.

The apartments are intended for private customers for short-term stays. Any booking is strictly personal and may not be transferred or sublet without prior written consent from THEAVA SAS.

3. Booking

A booking becomes final after:

  • Written confirmation from THEAVA SAS;
  • Payment of a deposit or full payment depending on the conditions specified at the time of booking;
  • Acceptance of these Terms and Conditions of Sale.

THEAVA SAS reserves the right to refuse a booking in case of unavailability, incomplete or incorrect information, or a prior dispute with the client.

Bookings are nominative and must be made by a legally competent adult.

4. Prices

Prices displayed on the website are in euros and include the provision of the apartment as well as the services described in the listing.

Unless otherwise stated, prices do not include:

  • Tourist tax;
  • Mandatory cleaning fees;
  • Optional services;
  • Any fees related to late arrivals or special requests.

THEAVA SAS reserves the right to modify its prices at any time. However, the applicable price is the one confirmed at the time of booking.

5. Payment

Payment terms are specified at the time of booking.

Unless otherwise stated:

  • A deposit may be required at the time of booking;
  • The balance must be paid before arrival;
  • A security deposit may be required prior to the stay to cover any damage, loss, or additional costs.

In case of non-payment within the required timeframe, THEAVA SAS may cancel the booking.

The security deposit may be withheld in whole or in part in case of damage, insufficient cleaning, loss of keys, or failure to comply with the house rules.

6. No right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, accommodation services provided on a specific date or schedule are not subject to the right of withdrawal applicable to distance sales.

Therefore, all bookings are final and binding.

7. Cancellation terms

Cancellation by the client

Cancellation conditions depend on the rate selected at the time of booking. They are detailed in the booking confirmation sent by email to the address provided by the client.

Cancellation by THEAVA SAS

In the event of an exceptional cancellation by THEAVA SAS (force majeure, inability to provide the accommodation, major technical issue), all amounts paid will be fully refunded, without any additional compensation.

8. Check-in and check-out

Check-in and check-out times are communicated prior to arrival.

Access to the accommodation may be provided via key box, keypad code, or handover of keys depending on the arrangements specified.

The client agrees to respect the indicated times. Any late arrival must be notified in advance.

9. Occupancy of the premises

The maximum number of occupants allowed corresponds to the capacity indicated in the property description. Exceeding this limit is not permitted without prior written agreement.

The apartments are strictly intended for residential and tourist use. Parties, events, gatherings, or noise disturbances are prohibited.

The client agrees to use the premises peacefully, respect neighbours, common areas, and building regulations. Any damage or inappropriate behaviour may result in immediate termination of the stay without refund.

10. Client obligations

The client agrees to:

  • Maintain the accommodation in good condition;
  • Respect equipment and furniture;
  • Report any issue or damage upon arrival;
  • Return the accommodation in proper condition;
  • Follow safety instructions and house rules;
  • Not smoke inside the accommodation;
  • Not bring pets when not authorised;
  • Not sublet or transfer the booking to a third party.

11. Liability

THEAVA SAS cannot be held responsible for:

  • Theft, loss, or damage to the client’s personal belongings;
  • Temporary service interruptions beyond its control (internet, electricity, water, air conditioning, etc.);
  • External disturbances, construction work, traffic, or local events;
  • Force majeure events as defined by French law.

The client is responsible for any damage caused by themselves or accompanying persons during the stay.

12. Insurance

The client is responsible for any damage they may cause to the property or third parties during their stay.

It is the client’s responsibility to ensure they have valid personal liability insurance covering this type of short-term rental.

13. Personal data

Personal data collected in the context of bookings is processed in accordance with the privacy policy available on the website.

14. Governing law

These Terms and Conditions are governed by French law.

In the event of a dispute, the parties will first seek an amicable solution before any legal action.

Failing an amicable agreement, the competent courts will be those within the jurisdiction of THEAVA SAS’s registered office.
